Telehealth Service Agreement

Please read carefully. By submitting your medical intake and proceeding to checkout on the KiteMD platform, you are consenting to receive telehealth services as described in this agreement. You must accept this agreement before your intake can be reviewed by a licensed physician.
1. Nature of Telehealth Services
KiteMD facilitates asynchronous telehealth consultations between you (the “Patient”) and independently licensed healthcare providers (the “Provider”). “Asynchronous” means the Provider reviews your submitted intake information, photos, and health history at a separate time from when you submit them — there is no real-time video or audio consultation.
The telehealth services available through KiteMD include clinical review for prescription-grade wellness treatments in the following categories:
- Anti-aging / Skincare: tretinoin and custom skincare prescriptions
- Hair restoration: minoxidil, spironolactone, and related treatments
- Weight management: GLP-1 adjacent protocols and related treatments
2. Informed Consent
By accepting this agreement, you acknowledge and consent to the following:
- Telehealth involves the delivery of healthcare services using electronic communications and information technology
- Your Provider will review your intake asynchronously and may approve or deny your request based on clinical judgment
- Telehealth has potential benefits including improved access to care and convenience, but also limitations including the inability to perform a physical examination
- In rare cases, information transmitted may be insufficient for appropriate clinical decision-making, and your Provider may request additional information or recommend an in-person visit
- You have the right to withdraw consent and discontinue telehealth services at any time
3. Patient Responsibilities
As a patient using KiteMD telehealth services, you agree to:
- Provide accurate, complete, and truthful health information during the intake process
- Disclose all current medications, supplements, and known allergies
- Disclose all relevant medical conditions, including but not limited to hypertension, thyroid conditions, pregnancy, and cardiovascular disease
- Upload clear, accurate photos when required by your selected wellness track
- Notify your Provider through the secure messaging system of any adverse reactions or changes in your health status
- Follow the treatment plan as prescribed and attend any recommended follow-up consultations
- Seek emergency medical care when appropriate — KiteMD is not an emergency service
4. Provider Qualifications
All Providers on the KiteMD platform are independently licensed physicians who hold active, unrestricted medical licenses in the state(s) where they provide services. Providers are credentialed by KiteMD before being granted access to the platform. Providers are independent contractors and are solely responsible for the clinical decisions they make.
5. Clinical Review Process
- You complete the multi-step intake form, including health history, photos (if required), and consent
- You authorize payment via Stripe Checkout; your payment method is authorized but not charged until a Provider approves your intake
- Your intake is routed to a licensed Provider in your state for asynchronous review
- The Provider reviews your information and makes a clinical decision:
- Approved: your payment is captured, your subscription becomes active, and the Provider initiates the prescription process
- Denied: your payment authorization is voided (no charge), and you receive an email explaining the decision
- If approved, you may communicate with your assigned Provider through the secure messaging system for ongoing care questions
6. Prescriptions and Pharmacy
If your intake is approved, your Provider may prescribe medication through a compounding pharmacy. KiteMD does not operate a pharmacy and does not dispense medications directly. Prescription fulfillment is handled by licensed compounding pharmacies that ship directly to you. Delivery times and availability may vary.
7. Limitations of Telehealth
You understand that:
- Telehealth is not a substitute for in-person medical care when a physical examination is necessary
- Not all conditions are appropriate for telehealth treatment
- Your Provider may determine that your condition requires an in-person evaluation and may decline to treat you via telehealth
- Technical failures may interrupt or prevent the delivery of telehealth services
- KiteMD is not an emergency medical service — if you experience a medical emergency, call 911 or go to your nearest emergency room
8. Privacy and Security
Your health information is protected in accordance with HIPAA and our Privacy Policy and HIPAA Notice. All PHI is encrypted at rest and in transit. Access is controlled by role-based security policies at the database level. All access to your health information is logged in an append-only audit trail.
9. Billing and Cancellation
Subscriptions are billed on a recurring monthly basis through Stripe. You may cancel your subscription at any time through the Stripe Customer Portal accessible from your patient dashboard. Upon cancellation, your subscription remains active through the end of the current billing period. No refunds are issued for partial months.
If your intake is denied, no charge is made. The payment authorization is voided automatically.
10. Risks and Disclaimers
As with any medical treatment, the treatments available through KiteMD carry potential risks and side effects. Your Provider will consider your health history and contraindications before making a clinical decision. Common risks may include skin irritation, allergic reactions, or other side effects specific to the prescribed treatment. You should report any adverse reactions to your Provider immediately through the secure messaging system.
KiteMD, Inc. is a technology platform and MSO — not a healthcare provider. KiteMD does not practice medicine, make clinical decisions, or guarantee treatment outcomes. All clinical decisions are made by independently licensed physicians.
11. Governing Law
This agreement is governed by the laws of the State of Delaware and the applicable laws of the state in which your treating Provider is licensed. Telehealth services are provided in compliance with the telehealth regulations of your state of residence.
